The purpose of these General Terms of Use (« GTU ») is to provide a legal framework for the terms and conditions under which the Cyber Investigation website is made available by ERIUM SAS, hereinafter « the Publisher », in the context of the contract with the Client and to define the conditions of access and use of the services by the User.
The present General Terms of Use are accessible on the website under the heading « GTU ». The Publisher reserves the right to unilaterally modify the content of these GTU at any time.
In case of non-acceptance of the GTU stipulated in this contract, the User must renounce access to the site and contact the Client’s representative with authority over the contract binding him/her to the Publisher.

1. Définitions

Publisher: ERIUM SAS is the owner of the Cyber Investigation website which is made available to the Client and its Users within the framework of a contract between the Publisher and the Client.

Client: refers to the employer-company that has signed a contract with the Publisher for the use of the Cyber Investigation website.

User: refers to any natural person under the Client's responsibility who may use the Cyber Investigation website, who has access to the functionalities and services offered by the website and who has accepted the General Terms of Use.

3. Personal data

In accordance with the regulations* in force in France and throughout Europe, the Publisher is committed to ensure the protection, confidentiality and security of the personal data of the Users of the site as well as to respect their privacy. Regulations in force are the General Data Protection Regulation (GDPR) and the French Data Protection Act (Loi Informatique et Libertés).
The personal data collected are identification data (surname, first name, e-mail address). These data are necessary for the use of the service. They are kept for the duration of the contractual relationship between the Client and the Publisher.
Within the framework of the awareness, Users’ conversations with the ChatBot made available by the Publisher in some scenarios can be collected. They are kept for the duration of the contractual relationship between the Client and the Publisher.
In accordance with the provisions of Law No. 78-17 of January 6, 1978 relating to computers, files and freedoms, no personal information is collected without the Users’ knowledge or transferred to third parties. The collected data is exclusively intended for the Publisher.
The User has a right of access, rectification and opposition to his/her data. The User can exercise his/her rights at the following address: contact@erium.fr.
If the exchanges about his personal data with the Publisher do not seem satisfactory to the User, he has the possibility to contact the Commission Nationale de l'Informatique et des Libertés (CNIL), the supervisory authority in charge of compliance with personal data obligations in France.

4. Responsibilities

4.1 Right of personal use:  The User's identifiers are personal and confidential and may not under any circumstances be transferred and/or shared with another person or resold.
4.2 User’s responsibility: The User is responsible for the management and conservation of his login and password. Consequently, it is up to the User to implement all necessary measures for their protection and conservation. The User is responsible for the consequences of their use. The Publisher shall in no case be held liable for any fraudulent use of the User's login and password. The User undertakes to inform the Publisher of any fraudulent use of the login and password as soon as he is aware of it.
4.3 Client’s responsibility: The Client undertakes to ensure that the security rules are known by its Users and that they undertake to respect them.
4.4 Publisher’s responsibility:
In the context of the awareness, the User is invited to leave the Cyber Investigation website in order to browse the Internet. The Publisher has no control over the web pages or social network sites not maintained by the Publisher on which Users may end up, and cannot, under any circumstances, be held responsible for their availability, their content or any unilateral modifications made by these third parties. The Users or the Client undertake to report any modification impacting the awareness to the Publisher in order to initiate the associated maintenance operations. The Publisher cannot be held responsible for any non-conforming use of the website by the Users.
The Publisher cannot be held responsible for any possible viruses that could infect the User's computer or any computer equipment, following the use of, access to sites, or the downloading of files from sites not maintained by the Publisher in the context of Users' research on the Internet. The list of the URLs concerned and maintained under the responsibility of the Publisher is accessible to the Client within a contractual relationship.
The sources of the information disseminated on the Cyber Investigation site are considered reliable, but the site does not guarantee that it is free of defects, errors or omissions.
The provided information is presented for general information purposes only and has no contractual value. Despite regular updates, the Publisher cannot be held responsible for changes in administrative and legal provisions occurring after publication. Similarly, the Publisher cannot be held responsible for the use and interpretation of the information contained in this site.
The Publisher cannot be held liable in case of force majeure or the unforeseeable and insurmountable fact of a third party.

5. Intellectual property

The brands, logos, signs as well as all the contents (texts, images, sound...) of the sites and profiles maintained by the Publisher, are protected by the Intellectual Property Code and more particularly by copyright.
The User must request prior authorization from the site for any reproduction, publication, copy of the various contents. He or she undertakes to use the contents of the sites and the profiles maintained by the Publisher in a strictly private context. Any use for commercial and advertising purposes is strictly forbidden.
Any total or partial representation of the sites and profiles maintained by the Publisher by any process whatsoever, without the express permission of the Publisher would constitute an infringement punishable by Article L 335-2 and following of the Intellectual Property Code.
It is recalled in accordance with article L122-5 of the Intellectual Property Code that the User who reproduces, copies or publishes the protected content must cite the author and its source.
